Traveling With Delta 8: Where Can You Fly With Delta 8 THC?
Yes, it is legal to fly with delta 8 THC as long as you are traveling with delta 8 in-between places where it is legal and you follow airline guidelines.
Delta 8 is federally legal and the TSA does not specifically look for it however, the local police do get called when drugs and suspicious items are found and you might get in trouble if you are in a state or country where it’s illegal.
Additionally, flying with vape cartridges, liquids, and edibles of any kind will have its own regulations from the airline.
Another issue to look out for when flying with Delta 8 THC is the amount of Delta 9 THC that is included. If you are flying to a location where only delta 8 is legal, you might run into problems if it contains any delta 9.
TSA Delta 8 THC Rules
In 2019, the TSA updated its rules due to the 2018 Farm Bill’s legalization of hemp and hemp-derived products.
Its previous rules stated that all “marijuana and cannabis-infused products,” were banned but its new rule makes an exception for “products that contain no more than 0.3 percent THC on a dry weight basis or are approved by the FDA,” referencing the 2018 bill for clarification.
Airline Delta 8 THC Rules
In addition to federal and state laws, the airlines also have rules when it comes to delta 8 thc oils, vapes, and edibles.
Oils & Liquids
According to the TSA, you’re allowed to carry one quart-sized bag filled with containers that hold 3.5 oz (100 mL) of liquid or less.
Other liquids, oils, aerosols, or creams should be packed in your checked luggage before your flight.
Vape Cartridges
According to Delta Air Lines, “Battery-powered electronic smoking devices, such as ‘e-cigarettes, e-cigs, e-cigars, e-pipes, e-hookahs, personal vaporizers, electronic nicotine delivery systems,’ can be brought as carry-on items only.”
Delta recommends placing your vaporizer in a special carry case or another secure container to prevent leaks or accidental activation, and the airline also prohibits passengers from charging vape devices while on the plane.
Gummies & Edibles
The TSA allows almost all food items through the security checkpoint, so long as none of them are liquids in amounts exceeding 3.4 ounces.
